2. Role of PVJets as air charter broker

PVJets is an air charter broker and private aviation advisor. It acts only as an intermediary between its clients (the “Charterers”) and independent third-party aircraft operators holding a valid Air Operator Certificate (the “Operators”).

PVJets arranges air transportation on behalf of Charterers by chartering aircraft from Operators. PVJets does not own, operate or maintain aircraft, and it is not an air carrier, contracting carrier or indirect carrier. Each flight is performed by the Operator, which has operational control of the aircraft and is solely responsible for operating the flight.

There is no contract of carriage between PVJets and the Charterer or the passengers. To the extent permitted by law, PVJets is not liable for any injury, death, damage, loss, accident or delay caused by the acts or omissions of Operators or other third parties, or arising out of or in connection with the carriage by air. Any liability that cannot be excluded by law remains unaffected.

Every booking arranged through PVJets is governed by the Aircraft Charter Service Contract (“ACSC”) and by the PVJets General Terms and Conditions, which set out the applicable liability provisions in full.

Nothing on the Website constitutes an offer to contract. Neither a quote request from a Charterer nor any quote sent by PVJets in reply is a binding offer: aircraft, prices and availability remain subject to confirmation until the ACSC is signed. PVJets may decline any request at its discretion.

Flights subject to US rules. Where the US Department of Transportation rules on air charter brokers (14 CFR Part 295) apply, PVJets states that:

1. PVJets is an air charter broker acting as the bona fide agent of the Charterer;

2. PVJets is not a direct air carrier or direct foreign air carrier in operational control of aircraft; and

3. the air services advertised on the Website, or in any other PVJets material, are provided by properly licensed direct air carriers or direct foreign air carriers.

3. Intellectual property

All content on the Website — including, without limitation, text, images, photographs, videos, graphics, logos, trademarks and distinctive signs — is owned by PVJets S.r.l. or by third parties that have authorised its use. It is protected by Italian and international copyright and intellectual property law, including Italian Law No. 633 of 22 April 1941 and the Italian Industrial Property Code (Legislative Decree No. 30 of 10 February 2005). Any reproduction, distribution, modification or use of the Website content, in whole or in part, without the prior written consent of PVJets S.r.l. is prohibited.

PVJets is a trademark used under licence. The PVJets name and logo may not be used without authorisation. Names and logos of aircraft manufacturers, aircraft models, associations and payment providers shown on the Website belong to their respective owners and are used only to identify the products, memberships and services concerned.

4. Disclaimer

PVJets takes care to ensure that the information published on the Website is accurate and up to date, but does not guarantee that it is free from errors or omissions. Information on aircraft, prices, availability, flight times and destinations is of a general and indicative nature and, unless expressly stated otherwise, does not constitute a binding offer. Articles in News & Insights, including those on regulatory and tax matters, are for general information only and are not legal or tax advice.

To the extent permitted by law, PVJets accepts no liability for the use of the Website, for any interruption of service, or for the content of third-party websites accessible via hyperlinks. Liability for wilful misconduct or gross negligence, which cannot be excluded (Art. 1229 of the Italian Civil Code), remains unaffected.

5. Governing law and place of jurisdiction

Use of the Website is governed by Italian law. The place of jurisdiction is Milan (Italy). Mandatory consumer protection provisions remain unaffected. In particular, consumers keep the protection of the mandatory rules of their country of habitual residence (Regulation (EC) No 593/2008), and may bring or defend proceedings before the courts of their place of residence or domicile under the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005) and Regulation (EU) No 1215/2012.
